RIGHT OF WITHDRAWAL.

Pursuant to art. 52 and ss. of the Italian Consumer Code, the user who covers the qualification of consumer has the right to withdraw from the purchase contract for the Product, within the statutory period of 14 days (so-called withdrawal period).

To exercise the right of withdrawal, the customer must communicate to the Company Poz Srl, before the expiry of the withdrawal period, his / her decision to withdraw, by sending the declaration of withdrawal to the following certified e-mail address poz@legalmail.it indicating the id number and date of the purchase order sent. The customer will have exercised his / her right of withdrawal within the withdrawal period, if the communication relating to the exercise of the right of withdrawal has been sent by the consumer before the expiry of the withdrawal period.

The return of the products must be made by the customer using a carrier of his / her choice and at his / her own expense, without delay, in any case within the term of 14 calendar days from the date on which he communicated his / her decision to withdraw. If the customer withdraws from the contract, the Company Poz Srl will refund the amount (sales price) without delay and in any case no later than 14 working days from the day of delivery of the goods.

The customer is solely responsible for the decrease in the value of the goods resulting from the handling of the product other than that necessary to verify the nature, characteristics and functioning of the product. The product must in any case be kept, handled and inspected with normal diligence and returned intact, complete in all its parts, fully functional, accompanied by its packaging.

In the event that the withdrawal has not been exercised in accordance with the provisions of the applicable legislation, it will not result in the termination of the contract and, consequently, will not give the right to any refund.

It is reminded to the customer that the right of withdrawal is excluded in the cases referred to in art. 59 of the Italian Consumer Code and, in particular, with regards to contracts concluded through the website, relating to the supply (c) of tailored-made goods or clearly personalized; (d) of assets that are likely to deteriorate or expire rapidly; (e) of sealed goods that cannot be returned for hygienic reasons or related to health protection and are open after delivery (eg creams, cosmetic products in general, food supplements, perfumes).
